Terms of Use

Welcome to Kinship Trees. These Terms of Use ("Terms") govern your access to and use of the Kinship Trees website and application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who may use the Service
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or guardian. By using the Service, you confirm that the information you provide when registering is accurate and that you will keep it up to date.
2. Your account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account has been accessed without your permission.
3. Your content
Kinship Trees exists to hold your family's photos, videos, recordings, documents, and stories ("Your Content"). You retain full ownership of Your Content. We claim no ownership over anything you upload.
So that we can operate the Service, you grant us a limited, non-exclusive license to store, process, back up, compress, and display Your Content — solely for the purpose of providing the Service to you and the people you invite. This license ends when you delete Your Content or your account, subject to a reasonable period for removal from backups.
You are responsible for Your Content. By uploading it, you confirm that you have the necessary rights to do so — including, where appropriate, the permission of family members who appear in it.
4. Sharing and invitations
You choose who can see your tree. When you invite someone, you choose their access level (view, contribute, or co-edit). You are responsible for the invitations you send, and contributors are responsible for the content they add. Content added by invited contributors is subject to these same Terms.
5. Free tier, subscriptions, and billing
- The Service is free to start. Every account includes 1GB of storage at no charge.
- If your archive grows beyond the free allowance, additional storage is available through a paid subscription. Prices are shown in the app before you subscribe.
- Subscriptions renew automatically until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
- If you reach your storage limit, uploads pause. Nothing is deleted, everything you have uploaded remains viewable, and you can export it at any time, free of charge.
6. Acceptable use
You agree not to use the Service to:
- upload content that is unlawful, infringes another person's rights, or that you do not have permission to share;
- harass, threaten, or harm others;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the Service, or use it to distribute malware or unsolicited messages;
- resell, scrape, or exploit the Service other than as intended.
We may remove content or suspend accounts that violate these Terms.
7. Your data belongs to you
You may export your full tree and all attached files at any time, in formats that work outside Kinship Trees. We do not sell your data, show you ads, or lock your history behind a paywall. See our Privacy Policy for details on how we handle your information.
8. Our intellectual property
The Service itself — including its design, software, name, and logo — belongs to Kinship Trees and is protected by intellectual-property laws. These Terms do not grant you any rights to use our branding.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. If your account is closed — by you or by us — you will have a reasonable opportunity to export Your Content unless we are legally required to prevent it.
10. Disclaimers
The Service is provided "as is" and "as available." While we work hard to keep the Service reliable and your archive safe, we cannot promise the Service will be uninterrupted or error-free, and we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We encourage you to keep your own copies of irreplaceable originals.
11. Limitation of liability
To the fullest extent permitted by law, Kinship Trees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose or fifty US dollars ($50).
12. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will give you reasonable notice — for example, by email or a notice in the app — before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Travis County, Texas.
